Using a surrogate to carry a child is a highly emotional issue for the intended parents, but it’s also a legal issue as well.

Some states in the US recognize the validity of using a surrogate mother to bring a baby to term.

Other states treat the use of a surrogate as a crime if the surrogate is paid for her services.

Pregnancy Laws

From a legal point of view a surrogacy arrangement is classified as being commercial or altruistic.

Commercial surrogacy is defined as a surrogacy arrangement where the surrogate mother is financially compensated for her surrogacy services and any expenses related to the pregnancy.

Altruistic surrogacy means the surrogate does not profit from the pregnancy, although she may be reimbursed for expenses, such as medical expenses, related to the pregnancy.
